Will Writing & Will Custody

The majority believe that having a Will is important but only a minority give it the urgency and priority it deserves. Out of ignorance or limited understanding, many do not realize the full potential of a Will. During our face-to-face Discovery session with our clients, many are overwhelmed by what a Will can do for them.

Our clients come from all walks of life. They need a Will for their own reasons and situations. Increasingly, they gain more out of the Will than they might expect. The use of Testamentary Trusts embedded in a Will is getting common.

Do not settle for a mediocre Will for a few ten’s or a couple of hundred’s dollars less. Your Will would one day be the instrument to distribute your estate that might be worth hundreds of thousands, if not millions of dollars.

Our fees may not be the cheapest in town, but we certainly bring the most value for your money.

Setup of Living Trusts

There are basically two types of Trusts. One is the Testamentary Trust which is written and embedded in a Will. As such, it takes effect only upon the death of the testator (the person whose last wishes are expressed in a Will). The other is the Living Trust which is governed by a separate trust deed and takes effect during the settlor’s lifetime (Settlor is a person who creates a Trust).

As soon as assets are placed in a Living Trust by the settlor, an annual management fee will be charged by a corporate trustee based on a percentage of the assets value under management. The use of Standby (Living) Trust is gaining interest and attention. There is no recurring management fee for a Standby Trust until a trigger event, such as premature death or mental incapacity of the settlor, takes place.

The ultimate use of three instruments, namely, a Standby Trust together with a simple “pour over” Will and a Lasting Power of Attorney (LPA) provides total peace of mind. Precepts Trustee would be the common denominator as the named trustee, executor and donee respectively. Its worth your while to hear us out.

Legacy Seminars

We wish to educate as many people as we can on Will and Trust matters.

Our one to one Discovery session is for individuals who have the intention to draft a Will. We would naturally educate them as we guide them along the Will Planning process. Discovery sessions are not meant to quench the thirst for knowledge. This can be best achieved through Legacy Seminars that are conducted on a regular basis.
